The conciliation hearing held this Monday (13), at the Superior Labor Court, between the Brazilian Postal and Telegraph Company (ECT) and the union entities that represent its employees ended without agreement. The collective bargaining agreement will now be sent for judgment by the Specialized Section on Collective Bargaining (SDC) of the TST.

Last Friday (10), the rapporteur of the case, Minister Agra Belmonte, had presented a proposal for a salary adjustment of 100% of the National Consumer Price Index (INPC) as of August, with the application of the same index for the rewarded functions. In other words, what the Court proposed was the simple correction of inflation, without any real increase for workers.

Still, the proposal was rejected by the company’s management. So, on Monday, the minister accepted, in part, the counterproposal of the state-owned company, so that the correction would only be implemented over five months, in three installments (50% in August, 25% in October and 25% in December).

The ECT, even so, rejected the social clauses of the proposal, which contemplated the access of union members to workers, the union’s participation in disciplinary administrative processes and release at the cost of union directors.

The workers’ representatives, in turn, questioned the linear adjustment for gratified functions and pointed out the wage gap between a postman, who earns an average of R$ 2,000, and positions such as lawyer, whose salary is around R$ 20 thousand, and that of company president, who, according to them, receives R$ 55 thousand.

With the impasse, the minister ended the conciliation and forwarded the agreement to the SDC, which has an ordinary session scheduled for next Monday (20). Until then, or until the date to be set for the judgment, it placed itself at the disposal of the company and workers in case there is any progress in the negotiations, opening up the possibility of a new hearing.

The main points of the proposal that were on the table this Monday are:

. Salary adjustment of 100% of the INPC retroactive to August 2021 and application of the same index to gratified functions, with repercussions on the remuneration installments;

. 100% readjustment of INPC on food stamps, including four sheets per month for business days;

. Access by union leaders to workers for 30 minutes at lunchtime, on pre-established days;

. Union participation in administrative disciplinary proceedings;

. Reinstatement of clause 20 of the 2019/2020 collective labor agreement, regarding the release with burden of union directors.


On August 17 this year, ECT employees started a nationwide strike, aiming at negotiating the conditions that will govern the category after the rules defined by the TST came into effect, which expired in July 2020. On 8/18 , the minister Agra Belmonte had determined the maintenance of the minimum contingent of 70% of the workers of each ECT unit while the strike lasted.

Employees also could not impede the free transit of goods, people and postal cargo in the units. At the moment, according to union entities, the operation is normal. Only the state of strike (mobilization) was maintained.

In the bargaining agreement, the company asks for a declaration of the abusiveness of the strike and maintains that, despite the profit of R$ 1.5 billion, the accumulated losses are close to R$ 860 million. For the company, the stoppage, at that time, would be “unwise”, as it would worsen its economic scenario, with an estimated daily loss of R$ 4 million.
