This Friday (8), the Court ordered the suspension of the decree signed by the mayor of Duque de Caxias, Washington Reis (MDB), which releases the use of face masks to combat the covid-19 epidemic in the city.
The judiciary established that the suspension is maintained “until the municipality submits a technical report duly based on scientific evidence and analysis of information on vaccination coverage”, especially among priority groups, in Duque de Caxias.
Last Wednesday (6), the Public Ministry of the State of Rio de Janeiro (MPRJ), through the 2nd Public Prosecutor’s Office for Collective Protection of Health in the Metropolitan Region I, and the Public Defender of the State of Rio de Janeiro joined with a request to suspend municipal decree 8.009/2021, which exempts the use of face masks in the municipality. The request was filed with the 3rd Civil Court of Duque de Caxias.
“Although the municipality actually had a technical study able to support its policy of releasing the use of masks, according to a court decision, the study should be presented before the elaboration of an eventual flexibilization decree. Note that the local epidemiological situation was not considered, and not even the situation of Metropolitan Health Region I, in which the municipality is located”, says one of the excerpts of the request.
The Scientific Committee of the State Department of Health (SES) will discuss today about the flexibility of the use of masks against covid-19. The indication is that no action is taken to change the current rule that requires face protection.
According to Extra, SES even released a note in which it states that Rio “is approaching the time when it will be possible to make the use of protective masks more flexible”. However, according to the folder, “it is still not possible to anticipate this scenario, since it is necessary to consolidate the drop in the number of cases and some care indicators, especially with regard to care in UPAs”.

The report highlights that the text states that “it is necessary to assess whether there will be a resurgence of cases in the elderly because of a fall in vaccine protection.” based on the evaluation of the professionals of the Scientific Committee. “At the moment, SES does not anticipate any decision making”, explained the folder in the note.
