The Justice of Rio de Janeiro upheld the decision that requires the use of masks from the population of the municipality of Duque de Caxias, in the Baixada Fluminense, denying the appeal filed by the city hall.

On October 5, Mayor Washington Reis (MDB) enacted a decree that released the use of facial protection alleging that the city had a high number of people vaccinated against covid-19.

One day after the decision taken by the Chief Executive of Duque de Caxias, the Public Prosecutor’s Office of the State of Rio de Janeiro (MPRJ), through the 2nd Public Prosecutor’s Office for Collective Protection of Health in Metropolitan Region I, and the Public Defender of the The State of Rio de Janeiro filed a request to suspend municipal decree 8.009/2021, which exempts the use of face masks in the municipality. The request was granted by the Court on October 8th.

Other times

Since the beginning of 2020, the MPRJ, through the 2nd Public Prosecutor for Collective Protection of Health in Metropolitan Region I, has filed several lawsuits for the Duque de Caxias City Hall to adopt sanitary measures to prevent and fight the pandemic of Covid-19.

In all these actions, there were court decisions favorable to the MPRJ, confirmed by the Court of Justice, among them for the municipality to obey the order of vaccination of priority groups of the National Immunization Plan; observe the deadline for application of the second dose of the vaccine against covid-19; suspend the decree that allowed the use of masks, until local epidemiological data demonstrated safety in this measure.
